Terms of Service
Back to homeThese Terms of Service ("Terms") govern your access to and use of Stampic ("Stampic", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.
1. The Service
Stampic is a SaaS platform that lets businesses create and operate digital loyalty programs delivered through Apple Wallet and Google Wallet, including card design, enrollment links, QR-based scanning, push updates, and analytics.
2. Accounts and eligibility
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for all activity under your account and for keeping credentials secure.
- You agree to provide accurate information and to keep it current.
- If you sign in with Google, you also agree to Google’s terms for your use of your Google account. You can revoke Stampic’s access at myaccount.google.com/permissions.
3. Acceptable use
You agree not to:
- Use the Service to violate any law, regulation, or third-party right.
- Upload unlawful, infringing, deceptive, or abusive content.
- Send spam or unsolicited communications through the Service.
- Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service.
- Use the Service to build a competing product.
4. Your content and your customers’ data
You retain ownership of content you upload (logos, branding, text, images). You grant Stampic a worldwide, non-exclusive, royalty-free license to host, process, and display that content solely to provide the Service. You represent that you have all rights needed to grant this license.
When you use Stampic to enroll your customers into loyalty programs, you are the controller of their personal data and Stampic is a processor. You are responsible for having a lawful basis to collect and use that data, for providing your customers with required notices, and for honoring their privacy rights.
5. Plans, fees, and billing
- Paid plans, features, and prices are described at checkout or in your order form.
- Fees are billed in advance and are non-refundable except where required by law.
- Taxes (VAT, etc.) may apply and will be added where required.
- We may change prices with at least 30 days’ notice, effective at the start of your next billing cycle.
- Non-payment may result in suspension or termination of the Service.
6. Free trials and beta features
Trials and beta features are provided "as is", may change or end at any time, and may have limits or fewer safeguards than generally available features.
7. Third-party services
The Service integrates with third parties, including Apple Wallet, Google Wallet, payment processors, and email/SMS providers. Your use of those services is subject to their own terms. We are not responsible for third-party services.
8. Intellectual property
Stampic and all related software, designs, and trademarks are owned by us or our licensors. Except for the limited rights expressly granted in these Terms, we reserve all rights. You may not remove or obscure any proprietary notices.
9. Availability and changes
We work to keep the Service available and secure, but we do not guarantee uninterrupted availability. We may add, modify, or remove features. We will try to give reasonable notice of material adverse changes.
10. Suspension and termination
- You may cancel your account at any time from your account settings.
- We may suspend or terminate your access for breach of these Terms, security risk, or legal reasons.
- On termination, your right to use the Service ends; sections that by their nature should survive will survive.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, to the maximum extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, Stampic will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to Stampic in the 12 months preceding the event giving rise to the claim, or EUR 100 if no amounts have been paid.
13. Indemnification
You will defend and indemnify Stampic against any third-party claim arising from your content, your use of the Service, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
14. Governing law and venue
These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. Disputes will be resolved by the competent courts of Warsaw, Poland, unless mandatory consumer protection rules in your country of residence require otherwise.
15. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the "Last updated" date below. Material changes will be communicated by email or in-product notice and will take effect no sooner than 14 days after notice, unless immediate changes are required for legal or security reasons.
